 Agency Terms and Conditions

Standard Terms and Conditions for Agencies supplying staff to FLOvate

  1. These terms and conditions apply in all cases for agencies supplying staff to FLOvate. Any other conditions or variations of these conditions only apply if agreed in writing by a FLOvate Director.
  2. All other terms and conditions agreed prior to 1st July 2001 are hereby terminated unless expressly agreed by a FLOvate Director in writing.
  3. The percentage fee payable for ALL placements will be 20% in the UK, 10% at our Indian office.
  4. Agencies should not send candidates for junior or trainee vacancies. For the avoidance of doubt this is any vacancy below £20,000 pa. FLOvate will not be liable to pay any introduction fee in all cases where this criteria applies.
  5. Agencies should not submit applicants for vacancies advertised in the local press unless requested to do so in writing. FLOvate will not be liable to pay any introduction fee in all cases where this criteria applies.
  6. Where a candidate is employed by FLOvate and subsequently leaves or is dismissed for any reason whatsoever the following refund of fees will apply.
    • Notice given within 6 weeks of employment start 100%
    • Notice given within 12 weeks of employment start 50%
    • Notice given within 18 weeks of employment start 25%
    • Thereafter no refund applies.
  7. Where a refund is due under clause (vi) a credit note for the amount of the refund should be issued within 7 days. The Agency will be given 28 days to source a replacement after which payment of the credit will be due.
  8. The sending of terms and conditions by the agency must be agreed in writing in all circumstances. Simply sending the terms does not constitute an agreement.
  9. Agencies are required to obtain two written references on behalf of FLOvate for each candidate offered employment. These must be received by FLOvate 7 days prior to employment commencing. FLOvate reserves the right to deduct £250 plus vat (Rs. 5,000 in India) from the final invoice should the Agency fail to deliver this.
